DishDash App Terms of Use

Welcome to DishDash! These Terms of Use govern your use of the DishDash mobile application ("App") provided by Search7 Pty Ltd ("Search7", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to comply with and be bound by these Terms of Use. If you do not agree with these terms, please do not use the App.

1. Use of the App

1.1 Eligibility: By using the App, you represent and warrant that you have the legal capacity to enter into these Terms of Use. If you are using the App on behalf of a business entity, you represent that you have the authority to bind such entity to these Terms of Use.

1.2 License: Subject to these Terms of Use, Search7 grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal or business use.

1.3 Prohibited Activities: You agree not to engage in any of the following prohibited activities while using the App:

• Any unlawful activity, including violation of any laws, statutes, ordinances, or regulations.
• Violating any third-party rights.
• Using the App for any unlawful or fraudulent purpose.
• Modifying, adapting, translating, reverse-engineering, decompiling, disassembling, or creating derivative works based on the App.
• Attempting to gain unauthorised access to any portion of the App or any systems or networks connected to the App.
• Interfering with or disrupting the operation of the App or servers or networks connected to the App.
• Using the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.
• Providing false, inaccurate, or misleading information.
• Posting User-Generated Content that depicts or incites others to commit acts of violence or may result in injuries, physical harm, and emotional distress.
• Engaging in gambling, including contests, lotteries, games of chance, bidding fee auctions, sports forecasting or odds making, Internet gaming, fantasy sports leagues with cash prizes, and sweepstakes.
• Spreading malware (e.g., viruses, worms, Trojan horses), spam, and other illegal messaging.
• Disseminating ethnically, racially, or otherwise objectionable information.
• Sharing sexually explicit, nude, libellous, harassing, violent, defamatory, abusive, profane, vulgar, threatening, hateful, obscene, or terrorism-related content.
• Advertising or encouraging the use of illegal substances.
• Copying, distributing, renting, reselling, modifying, compromising, damaging, disabling, impairing, or overburdening the App.
• Interfering with or abusing other users of the App.
• Using bots, scripts, or other automated methods.
• Collecting and disclosing any information about the users of the App.

2. Content

2.1 User Content: The App may allow you to submit, upload, or otherwise make available content, including text, images, videos, and other materials ("User Content"). You retain ownership of any User Content you submit, but by submitting User Content, you grant Search7 a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the operation of the App.

2.2 Prohibited Content: You agree not to submit any User Content that is unlawful, defamatory, libellous, obscene, pornographic, indecent, lewd, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable.

3. Privacy

3.1 Privacy Policy: Your App use is also subject to our Privacy Policy, which explains how we collect, use, and disclose your information. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

4. Intellectual Property Rights

4.1 Ownership: The App and all content, features, and functionality thereof are owned by Search7 or its licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 Trademarks: The trademarks, logos, and service marks displayed on the App are the property of Search7 or third parties. You are permitted to use these trademarks for the purpose of communicating and promoting the service to your customers.

5. Disclaimer of Warranties

5.1 The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Search7 disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

6.1 To the fullest extent permitted by applicable law, Search7 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

7. Governing Law and Dispute Resolution

7.1 These Terms of Use shall be governed by and construed in accordance with the substantive and procedural laws of the state of Queensland, Australia, without regard to its conflict of law principles.

7.2 Any dispute arising out of or relating to these Terms of Use or the App shall be exclusively resolved by binding arbitration conducted in accordance with the rules of Queensland, Australa. The arbitration shall take place in Queensland, Australia, and the language of the arbitration shall be English. The arbitrator's decision shall be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

8. Changes to the Terms of Use

8.1 Search7 reserves the right to modify or amend these Terms of Use at any time. Any changes to these Terms of Use will be effective immediately upon posting the revised Terms of Use on the App. Your continued use of the App after the posting of the revised Terms of Use constitutes your agreement to abide by and be bound by such changes.
